Carroll Arness Smith, 45, of Woodbridge (near Alexandria), has been charged with manslaughter as the result of an accident that occurred July 26, 2015. His passenger, Ellery Darnell Penn, 56, of Manassas, died as a result of injuries from the crash. Smith was also injured in the crash and has been charged with driving on a revoked license and driving under the influence. He is due in court on September 10, 2015.
Investigators from the Police Department’s Crash Investigation Unit were called to the scene early Sunday morning; the single vehicle crash occurred on Route 28 at Centreville Rd. and Rugby Road. Smith had been driving his 1996 Infiniti I30t and traveling south on Centreville, when his vehicle left the road and struck a utility pole. It was determined that he was under the influence of alcohol when the crash occurred.
Driving under the influence is a very serious charge. No longer can drivers simply get away with a “slap on the wrist.” Thanks to organizations like Mothers against Drunk Driving, drunk driving penalties have become much stiffer so that even nonfatal accidents can result in criminal charges. Drivers responsible for fatal accidents may be charged with crimes as serious as vehicular manslaughter; being convicted of such charges can mean drivers face stiff prison sentences.
Drivers who have been charged with driving under the influence and causing a fatal traffic accident most certainly need skilled representation from an Alexandria defense attorney (http://www.tuomeylaw.com/main/alexandria-criminal-defense.html). Such an attorney will be versed in current drunk driving laws and in the penalties that result from a drunk driving conviction. Drivers who are facing these situations have the best chance possible of receiving a fair sentence. In some cases, that may be a plea bargain. If a client is clearly guilty of the crime, a plea bargain can result in a less severe sentence because the defense and state attorneys agree upon a less severe sentence and reduction of charges in order to avoid having to go to trial.
If you have been charged with a DUI, it’s extremely important that you consult with an Alexandria defense attorney so as to determine the best course of action. This is especially important if you’ve been in an accident and have been charged with injuring another party or causing a fatality. Your experienced defense lawyer will investigate your case, explore all options possible, and come up with the best course of action possible, including defending you against all charges if you’re innocent and it should become necessary to go to trial.
If you have been injured in an accident involving an 18-wheeler, tractor-trailer rig or other large commercial vehicle, you need effective legal representation. Kansas City personal injury lawyers (O’Connor Law Firm) work on behalf of those who have sustained injuries due to negligence, regardless of whether an accident involved another car, motorcycle, or large truck. In cases that involve these “big rigs,” it is particularly important that you seek legal counsel right away. Trucking companies and corporations often send their own legal team to the scene right away, in order to limit the damage – and therefore, their liability.
Accidents involving these massive vehicles often end with victims suffering serious and even life-changing injuries. Without the support of a skilled Kansas City personal injury attorney, chances are the victim will not be fairly compensated. Insurance companies are manipulative and will find any way possible to lower the value of or deny a claim. Not only may you face substantial medical costs as a victim, but if you cannot work the financial impact will be even worse.
Injury lawyers in Kansas City know all too well the devastation an individual or even his/her entire family can face following an accident. Even though the accident was not your fault, your life has been turned upside down and the bills are becoming more than you can handle. A seasoned attorney will fight the trucking company and any other responsible parties vigorously on your behalf in his or her efforts to recover the monetary award you deserve. This compensation may include medical costs, lost wages, pain and suffering, even future income or medical costs should your injuries require future treatment, surgery, etc.
It’s never a good idea to go up against a trucking firm on your own, as they (along with their attorneys) will fight you tooth and nail. While it’s likely your Kansas City personal injury attorney will be able to settle your claim out of court by negotiating with the defendant(s) and the insurance company, an experienced lawyer is never hesitant to file a lawsuit and go to court when it is in the best interest of his or her client.
Why should you not go it alone? Because even though you are the victim of the trucking company’s or driver’s negligence, the burden of proof is on you. Kansas City personal injury attorneys are extremely familiar with the legal system and know what is necessary to obtain the best possible outcome for the client. When all you want is to get what you deserve, move past the pain, and put your life back on track, let a talented injury lawyer help.
Understandably, most people who have never suffered an injury caused by negligence only know as much about Kansas City personal injury lawyers as what they see on television or read in newspapers. However, when you become the victim, you want to make sure that the attorney you choose isn’t simply a greedy “ambulance chaser” who’s out for money. There is much that goes on that the average person does not know; if you or a loved one are in need of an injury attorney in Kansas City, here are a few facts you may find interesting or even comforting.
Your attorney will consider many factors, and ask numerous questions. For instance, it is important that he or she knows what type of claim is involved. Were you injured in an accident, because of a fall, due to a defective product or medical malpractice, or did the injury occur in the workplace?
An experienced and thorough Kansas City personal injury lawyer will likely ask the following questions as well:
Whose fault was the accident or incident? In some cases, it’s clear that one person is at fault. However, there are cases where fault is uncertain, or contested.
What is the extent of the injuries that have been identified currently?
Did the injured victim receive inpatient or outpatient care, or both? And what are the approximate costs for medical care?
Did police investigate? If so, were news media personnel on the scene, were pictures taken of the accident, and was an accident reconstruction report completed?
What was the date when the injury actually occurred? This is a very important question, as there are normally statutes of limitations in most states, meaning that there is a certain period of time in which a victim must file a claim. Otherwise, the claim cannot be filed.
Of course, before you choose the Kansas City personal injury attorney you want to represent you, it’s important to know his/her level of experience, and what credentials the attorney has. It is the job of your lawyer to reassure you and offer support, as most injured victims experience some level of both emotional and physical trauma. To many clients’ relief, most cases can be settled without filing a lawsuit, although some circumstances usually do require filing (premises liability and medical malpractice, for instance).
Kansas City personal injury lawyers make certain a thorough investigation is conducted; your attorney will review police and medical records, interview witnesses, examine the evidence and even collect more details about your physical/emotional state from friends, family members and co-workers in some cases to further support your claim of injury.
As you can see, the extent of what personal injury attorneys (http://www.ockclaw.com) in Kansas City actually do goes much further than what you see in the media. If you or a loved one have suffered injuries cause by negligence, do not hesitate to consult with a skilled lawyer.
Most people who are pulled over by police and arrested for driving under the influence do not think they need a Kansas City DUI attorney – particularly if it is their first offense. Today, operating a vehicle while under the influence of alcohol or any illegal substance is a criminal offense. Unlike a few decades ago when the punishment was hardly more than a slap on the wrist, the penalties are serious today. Even a first-time offender may find him or herself facing jail time, monetary fines, a suspended driver’s license and more.
Kansas City DUI lawyers know that over the past years, punishment for those who choose to driver under the influence has become much more harsh due to lawmakers, MADD (Mothers Against Drunk Driving) and others who want to stomp out drunk driving. This is totally understandable, but there are times when individuals are charged with DUI when they are innocent, or have only a very small amount to drink and are perfectly capable of driving safely.
It is perhaps even more important that you consult with a DUI attorney in Kansas City if you are a repeat offender. With each arrest and conviction, the consequences become even more harsh. Jail time increases, fines increase, and you may lose your driver’s license permanently. Additionally, you may be required to attend drunk driving school – and the odds of your insurance company dropping coverage get higher with each offense.
Not only are the penalties harsh, those who are convicted of driving under the influence face other negative consequences as well. Your reputation and career may be ruined, as well as relationships. You will have a criminal record, which can make securing employment extremely difficult. If there are other circumstances involved, such as an accident was caused because of driving in an impaired state or someone was injured, the punishment becomes even harsher.
Kansas City DUI lawyers understand the laws regarding DUI; they also know that police make mistakes, prosecutors are often overzealous, and there are defense strategies that can lead to a dismissal of the charges if effective. Regardless of the situation, the primary goal of your attorney will be to have the charges against you dismissed or reduced, so that there is less negative impact on your life. Whether it is your first offense or fourth, you must consult with an aggressive DUI attorney in Kansas City immediately.
You’ve suffered a serious injury in an accident, serious enough that you require medical treatment or cannot work. Instead of contacting a Kansas City injury lawyer to handle your claim, you decide you will save some money and represent yourself. This story is all too familiar, and unfortunately does not end well for the injured victim. Why?
Even though you are the one who was injured because of another party’s negligence or malicious conduct, the burden of proving that individual or party was negligent lies on your shoulders. The average person without the legal training, experience and skill of a Kansas City personal injury attorney has no idea what is required in order to prove your case. You must submit evidence, present medical and police reports if applicable, interview witnesses, make sure documents are filed properly and in a timely manner and more. If you decide you will just settle with the insurance company, good luck. Insurance companies do their level best to pay out low-ball settlements to injured victims – and will even use tactics such as putting partial blame on you in order to pay you as little as possible.
If you think you cannot afford to hire an experienced injury lawyer in Kansas City, you can. Today, the majority of personal injury attorneys work on a contingency fee basis, which means they only take a percentage of the award they recover for you (usually about one third) if they win your case. This means you pay no fees upfront, so you do not face out-of-pocket expenses that will put you further into debt.
Further, a Kansas City injury attorney will only accept your case if confident of a win; otherwise, he or she would not get paid. In the majority of cases you never have to file a lawsuit or go before a jury, as most seasoned lawyers are capable of securing the full damages you deserve out of court, whether through negotiations with the insurance company or with the responsible party’s attorney.
You may not even be aware of the full compensation you are entitled to. While most people know they should be compensated for medical costs, some never think of related expenses such as lost wages, or even future income if further medical treatment is required at a future date. You may be eligible for pain and suffering as well. Your Kansas City personal injury lawyer will work to determine the full value of your claim, so that you are not under compensated.
If you have been considering representing yourself after being injured because of someone else’s negligence, please reconsider. The expense you will likely face by going it on your own will ultimately be far more than what you would spend hiring a capable attorney to handle the legal issues for you.
Although it’s not entirely true that a Kansas City personal injury attorney can magically help you recover from your injuries if you’ve been the victim of someone else’s negligence, it is absolutely true that if you hire a good personal injury attorney to take care of your case for you, you can rest easy and let the bulk of the responsibility fall on his or her shoulders, instead of yours. In that indirect way, of course, your attorney can most certainly help you recover from your injuries, because you can focus on healing, for the most part, except for those times when your attorney asks you to participate.
It’s possible to get more money when you hire a personal injury attorney
There’s another important reason that hiring a Kansas City personal injury attorney is so important. When you negotiate with the insurance company, they have lawyers working for them. They know that you’re injured. They know that you need money (because of course, you’re probably out of work at least temporarily because of your injuries). They know that you probably don’t have the energy to fight with them, so they try to be kind and “understanding,” even though there are real alternative motive is to get you to accept a small amount of cash for your “trouble,” and then go away and leave them alone.
If you hire a personal injury attorney who knows what he or she is doing, though, it’s almost always true that you’re going to get more money through a personal injury lawsuit that goes to jury award, or settlement, then it is if you accept what the insurance company offers you up front. When you know that you deserve a bigger settlement and you’ve gotten, your attorney can help you get that goal.
Don’t sign any papers until you’ve contacted a good personal injury attorney
Your Kansas City personal injury lawyer will meet with you free of charge to discuss your case. There’s no obligation, no money out of pocket to retain a lawyer. Instead, you meet with him or her, discuss your case, and he or she will decide whether or not it has merit. If it does, he or she will take you on on contingency, meaning that you don’t pay anything to lawyer for representing you unless you win a jury award or settlement.
Once that happens, your lawyer will take a percentage of your settlement or award as compensation, usually about 30%. If you lose your case, though, you’re not out anything. You simply tried your best and are ready to move on.
It doesn’t cost anything to get in touch with a good Kansas City personal lawyer. Why not see if you can truly get the money you deserve by hiring one?
Are you the recent subject of an inquiry into drunk driving? Were you pulled over for suspicion of driving under the influence, or DUI? Did you register with a blood-alcohol level above the legal limit for Kansas City, such that now, you’re facing DUI charges? If you’ve been pulled over for DUI, you need a Kansas City DUI attorney to represent you in your case – even if you’re innocent. Here’s why.
“Innocent” does not necessarily mean “not guilty”
You may be innocent of driving under the influence, but that’s not good enough to prevent having to go through the court system to prove that innocence. If you try to manage your case yourself or do so only with the help of an inexperienced public defender, you could find yourself facing fines, loss of your driver’s license, or even jail time – yes, even if you’re innocent. A good and experienced Kansas City DUI lawyer will help make sure that your interests are represented fairly and that your innocence is protected.
You need to have experienced attorney as your mouthpiece
Again, you can very well be innocent and still be seen as guilty – even having to serve jail time, pay fines, or lose your license. Law enforcement is out to get drunk drivers, and rightly so. Drunk driving is a serious offense that kills or injures countless victims every year. However, even the best law enforcement officials can be overzealous and can erroneously try to get a confession out of you that you’ve done drunk driving even when you haven’t – or simply assume you’ve been a drunk driver when nothing could be further from the truth. When you’ve got a good Kansas City DUI attorney on your side, and you retain him or her right away as soon as you know you are in need of his or her services, your rights will be protected so that you are sure to have a truly fair day in court, whereby you can prove your innocence.
You need an experienced lawyer to help you build your case
When you hire an experienced Kansas City DUI attorney to represent you as soon as you are told you’ve been suspected of drunk driving, he or she will become very familiar with your case such that your representation will be as good as it can be. Even the best attorney can’t do the best job possible if you hire him or her only when your case is well underway; hire an attorney as soon as you can, however, and you will truly have due process available to you so that your innocence is proven and you can put this behind you.
When you suffer an injury due to an accident caused by someone else’s negligence, it can be a time of both physical and emotional pain and stress. Not only that, the financial stress can be enormous when you face substantial medical costs and in some cases are unable to work. This is why it is highly advised that you consult with an experienced Kansas City personal injury attorney who will work to secure the full damages you deserve for costs associated with your injuries.
There are lawyers who specialize in many fields; however, a Kansas City personal injury lawyer specializes in litigation pertaining to negligent accidents and circumstances, seeking to protect the legal rights and financial security of his/her client. Your attorney will determine the amount of compensation you may be entitled to based on the seriousness of the injury, and possible long-term effects. What many people do not realize is that they may be entitled to more than just medical expenses, including loss of income, pain and suffering, even loss of future income in some circumstances.
It’s important to hire a skilled Kansas City personal injury attorney whether you settle with the insurance company out of court, or choose to litigate. Insurance companies are not in the business of being fair, and will devalue your claim or even try to find ways to deny it. Should you decide to go to court, you can be sure the responsible party will have a defense attorney who will be fighting against you every step of the way. Your accident lawyer will gather the essential evidence to prove your case, and secure medical experts or even professionals to reconstruct the accident/circumstances which led to your injuries. He/She will also secure essential reports, gather witnesses for relevant testimony, and ensure all documents are filed in a timely manner.
A serious accident or circumstances can leave you severely injured, even permanently disabled in some cases. It is vital that you consider how you will pay the household bills and support your family, and pay medical expenses. In addition to this, securing the compensation you deserve also helps to hold the negligent party accountable for his or her actions.
Serious injuries caused by negligence can be financially devastating, perhaps even leading to bankruptcy. Get the full damages you deserve so that you can move forward and put the situation behind you by hiring a capable Kansas City personal injury lawyer.
Nearly everyone gets behind the wheel after having a drink or two in all honesty; unfortunately, some people get caught. If you have ever heard the saying “The person who serves as his own lawyer has a fool for a client,” it’s absolutely true. In Missouri, driving under the influence is punished harshly. This is why you must hire a capable Kansas City DUI lawyer to defend your legal rights and protect you from harsh criminal penalties!
Business meetings often involve dinner and drinks; perhaps you were at a friend’s home watching the game, and had a few beers. It’s happened a dozen times, but his time you get pulled over for a broken taillight or failing to come to a complete stop at a stop sign. You pray that the officer won’t smell alcohol, or decide to give you a Breathalyzer test – but he does. What should you do next? Don’t say a word before contacting a talented DUI attorney in Kansas City.
Missouri is like many other states in some regards; for instance, it is illegal for an adult to drive when his/her BAC is .08 or higher. For an individual younger than 21, it is illegal to drive with a BAC of .02 or higher. However, Kansas City DUI lawyers know that there is also what is known as an implied consent law, which simply means that motorists who are suspected of driving under the influence of alcohol or drugs automatically give their permission to be tested via breath, blood, or urine for the presence of alcohol or drugs. Refuse to submit to testing, and your driver’s license is automatically suspended.
A qualified Kansas City DUI attorney is thoroughly familiar with all of these laws, but also knows that mistakes or errors are often made by police and prosecutors. There are certain guidelines in arresting someone for driving under the influence. For example, police must have reasonable suspicion to pull you over. Field sobriety tests must be properly administered, and equipment used to administer breath tests aren’t always calibrated properly. There are many things that may be used by an attorney in defense of his/her client to have charges either dismissed or reduced in order to limit the negative impact to his/her life.
The penalties for a conviction are severe, and include not only possible jail time, but fines, court costs, driver’s license suspension, and a criminal record among other things. If you have been arrested for driving under the influence, don’t attempt to handle it on your own. Contact an aggressive Kansas City DUI lawyer immediately.
Do you really need a Kansas City DUI attorney when you’ve been arrested for driving under the influence? After all, if you’re guilty why bother? The fact is, there are some very good reasons to hire a lawyer when you have been charged with DUI, not the least of which is it may be possible for a skilled attorney to have the charges against you dropped, although that can never be guaranteed.
Here are a few of the reasons you should consider hiring a skilled and aggressive Kansas City DUI defense lawyer:
Attorneys who are appointed by the court do not specialize in cases involving DUI. This means that the results may not be as favorable as they could be if you were to hire a lawyer who does specialize in providing legal representation for those charged with driving under the influence.
Kansas City DUI attorneys are often capable of having fines reduced. Those who are convicted on charges of driving under the influence often incur penalties which include steep fines. A seasoned lawyer may be able to have those fines reduced considerably. A great article can be found here – titled: » Don’t Face Kansas City DUI Charges Without the Help of a KC Lawyer
Competent lawyers can often have jail time reduced. While every attorney’s goal is to have the charges completely dismissed, this is not always possible in every case. However, a capable attorney can often have jail time reduced so that his or her client spends less time behind bars.
Trusted DUI lawyers in Kansas City are experienced with field sobriety tests. Most skilled attorneys know that field sobriety tests aren’t always performed properly, and the reliability of those tests can be questionable. Your attorney will challenge not only those results, but the validity of blood/breath tests as well.
Skilled attorneys have the necessary expertise to present evidence in a way that is relevant. While you may feel that all of the evidence stacks up against you, your lawyer knows how to use evidence in your favor. Police make mistakes just like everyone else; your attorney will review police reports, question police, examine the evidence, challenge test results and more in order to find any and all possible weaknesses in the prosecution’s case.
It all boils down to one simple fact: the court will be prepared to convict you which will impact your future in more negative ways than you understand. Shouldn’t you be prepared to fight on your own behalf? The best possible action you can take to protect your future, freedom and career is to consult with a trusted Kansas City DUI lawyer.
If you have been injured, and need a criminal defense attorney or personal injury attorney as well, consider The O’Connor Law Firm as your trusted legal counsel.
Recently, a frightening Kansas City bus crash in the KC Missouri area left 13 injured passengers along with 2 others injured in the vehicle that was involved in the accident. In all, 16 people were involved in the crash, 14 of those hospitalized in four local hospitals. Roads were reported to be wet and slippery when the auto accident took place.
Kansas City personal injury lawyers represent individuals who sustain serious injuries in any type of accident, including bus crashes. Regardless of whether the accident was the fault of the bus driver or the other vehicle involved, you may be entitled to compensation if your injuries require medical treatment or cause you to be unable to work.
News reports indicate that a car pulled from a service station out into the road in front of the bus. The bus then clipped the car, causing it to swerve to the right and roll down an embankment where it landed upside down. Most of the injuries suffered by those involved were minor, though a few were serious. Non were life-threatening, and many believe that the rain-slicked roads played a major part in the accident, as the silver car’s tires could not get traction to get over the hill.
While 13 injuries is a substantial number, thankfully no one died a wrongful death in the crash or suffered injuries which were life-threatening. Regardless of how victims are injured, when it is the fault of another party you may be eligible for compensation of not only medical costs, but lost wages, future income if you are unable to work for the long term, pain and suffering, repair to any property damaged in the accident and more.
Kansas City personal injury attorneys represent injured victims involved in all types of accidents including bus crashes, car or motorcycle accidents, slip and falls, because of medical negligence or nursing home abuse, or who are injured in the normal use or consumption of defective products or drugs. While serious car accidents are the leading cause of catastrophic injuries across the U.S., other circumstances involving negligence or misconduct often lead to injury as well.
Hopefully those 13 who sustained injuries on board the bus that crashed in Kansas City had capable legal representation, particularly those who were seriously injured. Without a qualified injury lawyer, it is doubtful that those injured will receive the full damages they are entitled to. No matter how you are injured, never settle with the insurance company or take matters into your own hands without first consulting with a skilled Kansas City personal injury attorney.
The fact is, most people who are injured because of the negligence of another party/person don’t know what to do or where to turn. An experienced Kansas City personal injury lawyer knows that the absolute worst thing a victim can do is hand it all over to the insurance company, and trust they will handle it properly – but that’s easy to do when you’re injured, in pain, and in no mood to get involved in a legal mess.
Injury attorneys in Kansas City are dedicated to handling all of the legal issues for you, and skilled in negotiating with the insurance company. Without effective legal counsel, the odds are you will face a financial crisis at some point in the future. Medical costs continue to soar higher, and if you’re unable to work because of your injuries it only makes matters worse. Once the insurance company makes you an offer and you accept it, you can not take legal action. Will it be enough money to take care of all of the medical expenses you may face, even if you require therapy or rehabilitation in the future? Unfortunately, many injured victims find months or even years down the road they are facing bankruptcy, simply because they were not sufficiently compensated for costs associated with their injuries.
Of course your Kansas City personal injury attorney will work to build a strong case on your behalf, but he/she does much more than that. Your attorney will explain the process to you, gather evidence, examine medical and police reports, even determine the value of your claim. There is much to be said for having a skilled lawyer on your side when you’ve been injured because of someone else’s wrongful act or negligence; your attorney is your biggest ally. Your lawyer’s primary goal is to hold those who are responsible for causing your injuries accountable, so that you can live normally and get your life back on track, free from financial burdens. An array of injuries can occur, everything from wrongful death cases to slip and fall injuries as well as nursing home abuse or neglect.
Regardless of whether you have been injured in an auto accident, because of food poisoning, premises or product liability, medical malpractice or in a boating or motorcycle accident, it is imperative that you seek legal guidance before you ever speak to the insurance company. A compassionate personal injury lawyer in Kansas City will work diligently to protect your interests, and secure the full damages you deserve for all that you have been through.
When you have been injured in an accident caused by the negligence of another party, your first instinct may be to accept what the negligent party’s insurance company offers. However, a skilled Kansas City personal injury attorney knows that this is not to your advantage. Insurance companies lower the de-value your claim as much as possible, or may even attempt to refuse payment of costs associated with your injuries. A capable injury lawyer in Kansas City will fight to ensure you get the full compensation you deserve when someone else’s negligence has caused you injuries that resulted in substantial expense.
You are likely in pain, perhaps even unable to work. The last thing you want to do is haggle with the insurance company. Sure, they will offer their sympathy and show concern, but their primary concern is that they protect their own profits. Your Kansas City personal injury lawyer will negotiate with the insurance company in order to reach a fair settlement. If the insurance company refuses to compensate you fairly, your attorney will not hesitate to take your claim before a jury in court.
What will a personal injury attorney in Kansas City do to ensure you get the full compensation you are entitled to for costs related to your injuries? Your lawyer will collect essential evidence, review the accident and medical reports, investigate the accident, interview witnesses and more. He/She will also determine the value of your claim, and work diligently to present the details in a way that will prove that the responsible party was indeed negligent, and should be held liable for the costs associated with your injury.
Most accident victims face far more expense than they first realize when all is said and done. Depending on the extent of your injuries, you may require long-term medical treatment, therapy, rehabilitation, or you may be unable to work for an extended time period, possibly forever if you are disabled. Kansas City personal injury lawyers realize that medical expenses are the number one reason so many people face bankruptcy today, and that injured victims can find themselves in this predicament without the legal guidance and support of a skilled lawyer.
Do you really need a personal injury attorney in Kansas City if you have sustained injuries in an accident that was the fault of someone else? Absolutely, if you want the full monetary damages you deserve for what you have been through.
You have been arrested for driving under the influence, and now you assume that you will simply have to pay the fines and take your punishment, particularly if you are guilty of the offense you have been charged with. Why hire a Kansas City DUI attorney? Because without proper legal representation, chances are high you will face serious consequences. These consequences could include the loss of your job, your freedom, and your reputation. A criminal record is not something you can brag about, and most employers frown upon it.
Other penalties you face, even when convicted on a first offense, include fines, possible jail time, demerit points on your driving record and loss of your driving privileges. DUI lawyers in Kansas City Missouri know that if you did agree to take a breath test, you have only 15 days to file an appeal; if you refused the test, you have 30 days. In either case, if you do not file in the time period allowed your license will be revoked for a minimum of one year. This is another area in which a skilled DUI lawyer in Kansas City can help.
In some cases an individual is pulled over on suspicion of driving under the influence when he/she has not consumed alcohol or any illegal substance. For instance, you may have taken a prescription or over-the-counter medication for a medical condition that caused you to drive in a way that made the police officer suspicious. Or, you may not have taken anything at all. Even though you are sure of your innocence, that doesn’t change things in the eyes of the law. You still need a dedicated and aggressive Kansas City DUI attorney on your side, one who can uphold your innocence and have the charges dismissed.
Subsequent offenses bring harsher penalties. A second or third offense means higher fines, a longer jail sentence and possibly permanent suspension of your driver’s license. You may be required to attend drunk driving school. Your auto insurance company will likely increase your rates, or even drop coverage if it feels you are too high a risk. There are many defenses a capable Kansas City injury lawyer can use to protect your freedom, rights and future.
Even if you are guilty, it must be proven – which is exactly what an attorney attempts to prevent. If you or a loved one have been charged with driving under the influence, do not waste time. A Kansas City DUI attorney will work vigorously to have the charges against you dismissed or reduced, so that you can get back on a positive track without suffering damaging consequences to your life and career.
Do you associate Kansas City personal injury lawyers with car accidents? Most people do, unfortunately. This may be due to television commercials and other media advertising that often relate personal injury to car accident victims. The truth is, a Kansas City personal injury attorney offers legal guidance, support and litigation skills to those injured in any type of accident that is caused by another person or party. These accidents include slip and fall, boating accidents, injuries caused by defective or mislabeled products, dog bites or attacks, pedestrian accidents, construction site accidents and more.
The point is, if you sustain serious injuries that could have been avoided if the other party had acted responsibly, a personal injury attorney in Kansas City can handle the legal issues for you and work to ensure you are fairly compensated. Handling a situation in which you are injured seriously enough to require medical attention or to prevent you from working on your own is not advised. Why? Most people aren’t familiar with the laws regarding personal injury, and do not know how to collect and examine evidence, analyze police reports, etc. In addition, the insurance company will offer you a low-ball settlement, which can be very enticing when you’re financially strapped and need money. In order to get the full compensation you deserve for medical expenses, lost wages, pain, suffering and other costs, you need a capable Kansas City personal injury lawyer on your side.
Unfortunately, there are circumstances in which surviving family members need the skill and services of an experienced lawyer. Most personal injury attorneys provide their services in the case of wrongful death. This means that your loved one or family member was fatally injured because of another person or party’s negligence. Often, serious injuries end in the loss of a life. This is when a Kansas City personal injury attorney may determine it best to file a wrongful death lawsuit. In these types of cases, survivors are often entitled to compensation for costs mentioned above, along with punitive damages, loss of companionship, loss of future earnings, funeral expenses, loss of inheritance and even more.
As you can see, the scope of practice for a personal injury lawyer goes far beyond car accidents. No matter how you were injured, or if you lost a loved one because of someone else’s negligence or misconduct, it is crucial that you allow a trusted and reputable Kansas City personal injury attorney to handle all of the legal issues and build a strong case on your behalf. Injuries often go far beyond the physical pain, affecting your life in ways that you cannot imagine. Those who are responsible should be held fully liable for their negligent actions.
Individuals who have sustained injuries caused by another person’s negligence or wrongdoing need a skilled Kansas personal injury lawyer on their side. Why? There are several reasons, the most important being that the insurance company rarely gives an injury victim the full compensation he or she is entitled to. Most people know that when they have been injured because of someone else’s negligence, they can seek the advice of a Kansas City personal injury attorney. But, most don’t know what an injury lawyer actually does on behalf of his/her client. If you or someone in your family has sustained serious injuries in an accident, you will be enlightened regarding the responsibilities of a Kansas City personal injury lawyer after reading this article.
When an individual or company fails to act in a responsible manner and it results in damage or injury, that individual/company may be held liable for expenses related to the injuries or property damage a victim suffers. Whether you were injured in a car accident, or while on someone else’s property which was unsafe, your Kansas City personal injury attorney will work to gather the facts and investigate the details surrounding your injury. He or she will analyze all of the facts in order to determine which party or parties were negligent and may be at fault.
Once it is determined who is actually at fault in the accident, a personal injury lawyer in Kansas City may attempt to negotiate a cash settlement with the responsible party’s insurance company that is satisfactory and will cover the victim’s monetary needs which may include medical expenses, lost wages and more. If a satisfactory settlement cannot be reached, your attorney may determine that it would be to your advantage to file a lawsuit. In many cases, settlement is handled out of court, as most defendants and their insurance companies do not want to face a costly court battle. Therefore, they are willing to pay a fair settlement when a lawyer appears on the scene, instead of the small pittance they may offer to the victim who does not have legal representation.
An experienced Kansas City personal injury lawyer is not intimidated when it becomes necessary to go to court. If you, as the victim, are not satisfied with the out-of-court settlement offered by the defendant and/or his insurance company, your attorney will take strong evidence into court in order to prove negligence on the part of the defendant. For instance, your attorney will be able to prove that a motorist was speeding, driving recklessly or engaging in other activity that resulted in the crash that caused your injuries. He/She may present eyewitness testimony, videos of the crash or other evidence.
These are just a few examples of what you should expect from your Kansas City personal injury attorney. While the average person never knows it, injury lawyers spend a considerable amount of time digging into the details, investigating behind the scenes in order to reveal exactly what happened, gathering evidence and reviewing that evidence in order to prepare a solid case. If you have been injured because of another party’s negligence, it is to your advantage to let a trusted Kansas City personal injury lawyer handle the legal issues.
Sometimes, accidents that cause personal injury are avoidable, and sometimes they’re not. The most frustrating of these accidents happens when someone else’s carelessness or negligence causes that accident or incident to occur. It didn’t have to happen, but if you’ve been the victim of one of these incidents, you’re now left to deal with the consequences. If your injuries are relatively minor, you may heal, but you may be left with significant medical bills nonetheless, and you will certainly have to deal with the trauma, pain and suffering you’ve gone through.
Although no legal action is going to entirely be able to erase what you’ve gone through, filing a personal injury lawsuit can at least help make sure you receive compensation for your injuries. However, don’t try to do it by yourself. Personal injury attorneys in Kansas City are experts in these types of cases, and they can help you both prepare your case and present it in court or for settlement, as necessary.
What can a Kansas City personal injury lawyer do for you?
First, your lawyer will review your case to make sure it is legitimate. There’s no point in wasting time on a case if it’s frivolous, and plaintiffs have indeed sometimes filed frivolous lawsuits. They’re a waste of time for both the legal system and the lawyers involved in them, and they’re not fair to the so-called “defendants” who must suffer through them when they’ve done nothing wrong. This is not to say that your case is frivolous, by any means. It just means that your lawyer will be very careful to make sure it’s not before he or she agrees to take it on.
Once your attorney has reviewed your case and agrees to take it on, he or she will represent you during the case to get you the best possible outcome, whether that’s a jury award or settlement. Most Kansas City personal injury attorneys don’t ask for money upfront and instead will take a portion of your settlement or jury award once you’ve won your case. If you lose your case, you owe your lawyer nothing.
It’s better work with a Kansas City personal injury attorney instead of on your own
As you can see, there’s no risk to you if you work with a Kansas City personal injury lawyer when you construct your case. In addition, working with a lawyer will likely get you better compensation than you would get if you were to try to negotiate on your own with the insurance company. Let the experts handle your case; use the services of Kansas City personal injury lawyers for the best possible results.
